Never issued a letter of award to GMR for Nagpur Airport Project: MIHAN to HC

Nagpur: MIHAN India Ltd on Friday informed the Bombay High Court that it had never issued a letter of award to GMR Airports Ltd for upgradation of the international airport at Nagpur and had stated that the final decision depended on the Centre”s approval.

MIHAN, a joint venture of Maharashtra Airport Development Company and Airports Authority of India, filed its affidavit before the Nagpur bench in response to a petition filed by GMR Airports, challenging the cancellation of the bidding process for development and management of the Dr Babasaheb Ambedkar International Airport.

GMR Airports in its plea said it was awarded the project by way of a letter of award on March 7, 2019 and hence, annulling the tender in a letter dated March 19, 2020 was “unjust, arbitrary and illegal”.

However, MIHAN claimed that the communication sent to the petitioner on March 7 was only a bid acceptance letter and not a letter of award.

MIHAN said the letter clearly stated that the acceptance of the bid was conditional and required approval from the Union Ministry of Civil Aviation.

As per the affidavit, the state government in December 2017 had set up a Project Monitoring and Implementation Committee and in September 2018, it had received bids for share of gross revenue from Consortium of GVK Airport Developers Ltd with Mumbai International Airport Ltd and GMR Airports.

“Though the bid for share of gross revenue from the petitioner was the highest with 5.76 per cent, it was still financially very low and detrimental to the public exchequer,” the affidavit said, adding GMR was asked to reconsider the revenue share percentage and provide a revised quote.

GMR then increased the bid from 5.76 per cent to 14.49 per cent.

“Following this, by a communication dated March 7, MIHAN only communicated acceptance of the revised bid for purpose of further consideration,” the affidavit said.

It clarified that the communication clearly stated that the acceptance of the bid was subject to approval from the Centre.

MIHAN further said the Ministry of Civil Aviation had expressed its dissatisfaction on the revenue share offered by the petitioner and questioned its financial viability, considering the present revenue being generated by the Nagpur Airport.

“MIHAN is contemplating floating a tender wherein the financial model will be different from the one proposed in the first tender, which now stands cancelled,” the affidavit said.

It also refuted allegations that the decision to cancel the tender was politically motivated and said the decision of re-tendering was taken on October 14, 2019, which is before change in the government on November 28.

The Nagpur bench of HC on Friday posted the matter for further hearing after four weeks.

The Institute of Company Secretaries of India (ICSI), celebrated its first virtual PCS Day on 15th June 2020 through a series of deliberations on the significant role of Practicing Company Secretaries, Recognitions awarded to them and their emerging areas of practice with eminent speakers from across the country.

Hon’ble Minister of State for Finance and Corporate Affairs, Shri Anurag Singh Thakur graced the occasion as the Chief Guest of the program and appreciated the efforts and role that Company Secretaries have been playing in creating awareness about the reform measures taken by the Ministry of Corporate affairs, Government of India.

Shri Thakur emphasizing on the three ‘Es’ said that “Quality Education and Employment Opportunities will lead to Empowered Company Secretaries who in turn will Empower the country.” In his admiration for the ICSI Motto, Shri Thakur added that “ICSI Motto – Satyam Vada Dharmam Chara – speaks volumes of the values ICSI imbibes in the Company Secretary Professionals, who are going to play an important role in making the Country, one of the top three Economies of the World. The more the world invests in India, the more will be the demand for Company Secretaries in the country.”

CS Ashish Garg, President, ICSI rejoicing the spirit of the day, echoed the sentiments of thousands of Practising Company Secretaries by acknowledging the responsibility showered onto the Institute by the Regulatory Authorities and the Government of India in making India a five trillion Economy by 2024.

June 15 has been earmarked as one of the most remarkable days for the profession of Company Secretaries, for it was the 15th of June 1988 that Company Secretaries in Practice were accorded recognition for Certifying the Annual Returns under the erstwhile Companies Act, 1956.

A special session with MCA Joint Secretary Shri Manoj Pandey and two Panel Discussions on – “Emerging Ecosystems & Business Framework: Reinventing the Profession”, and “From Profession to Entrepreneurship: The Transformation” redefined the role and responsibility of Practising Company Secretaries in newer avenues and highlighted the adaptability of the Professionals to the digital era.

Shri Manoj Pandey, Joint Secretary, MCA rightly said, “Company Secretaries should now be seen as Corporate Secretaries for they are playing roles beyond that of the traditional Compliance Officers and are helping in bringing in International Business to the country”.

Rita Industries at Kanhan usurp agricultural land during Lockdown

Nagpur: The Covid-19 lockdown across the country for the past 70 odd days has kept billions of Indians at home, but Nagpur-based Rita Steel & Industries has used the lockdown to brazenly usurp agricultural land belonging to farmers and another adjoining company premise in brazen disregard of the existing laws of the land.

It’s a simple case of using the absence of manpower during lockdown to chop off 70 fully grown healthy trees and blatantly capturing land belonging to Nagpur Power Company and farmers in connivance with local authorities. Says a local farmer whose land was also captured by Rita Steel, “The brutal felling of 70 odd large trees can never be undone. Those trees had survived droughts, famines and many natural calamities. They bore testimony to our ancestors’ land. It is a matter of deep anguish to all of us.”

In mid may, amid lockdown, an attempt was made to widen the pathways passing through the property of Nagpur Power & Industries Limited in Kanhan, Nagpur. On inquiring it was revealed that the local Nagar Parishad was doing some repair works. However, the municipal body as well as the local state Public Works Department (PWD) denied having commissioned any such work. An FIR was filed in the local police station against the illegal construction activities.

On 11 June, 2020, without any prior intimation or reasonable notice, some engineers from the tehsildar’s office and a local contractor by the name of Tushar Rawal along with a team of local police officers arrived on the property to do mojni (survey measurement of land). The collusion of these three authorities emboldened them to forcibly start work on the road.

The team trespassed into the industrial premises of Nagpur Power and caused irreparable damage. They destroyed the boundary wire fencing and poles, uprooted, cut and demolished a large number of fully grown trees and plants and other assets. They then proceeded to illegally build a road with the help of JCB Machines, Dumpers, Falkland etc.. The work continued till next day evening during which they even broke the railway tracks entering the land parcel of Nagpur Power connecting to its railway siding. A complaint to SEC Railways has also been made. In this blatant abuse of power and political influence, a lot of villagers’ farm lands have also been destroyed.

In the suit filed at the Nagpur Civil Court, the petition whose copy is with this correspondent, reads, “(Nagpur Power & Industries Ltd.) submits that the land situated at Survey Nos. 101 and 106 entirely belongs to the plaintiff (Nagpur Power) and there is no Pandhan or the way for the movement or egress or the outgress exists. Under the circumstances, to carry the construction in the private land of Nagpur Power & Industries Ltd. is illegal and in violation of the Law.”

Clearly the lockdown and its consequent stay-at-home norm prompted the owners of Rita Steel whose premise adjoins that of Nagpur Power in Kanhan to commence this illegal work. The connivance of local authorities clearly points to some kind of political influence. While cases have been filed in the civil court of Nagpur, it remains to be seen how the current coalition government formed with support of independents deals with the issue.

Mr Gaurav Agarwala a leading real estate entrepreneur while expressing his views in the webinar on the real estate sector said that one of the worst hit industry in this corona phase.The real estate projects have come to a standstill since last 3 months mainly because of the non availability of raw materials, labourers moving to their native place,paucity of funds,pending clearances etc.But he was confident that after July the sector will bounce back with good demand specially for low cost housing projects.Importance of a good Home is realised to stay safe and therefore govt should support real estate developers to make affordable houses for everyone & he felt that housing loan rates should further be reduced for regeneration of demand & PMAY subsidy should be increased to boost up the sector.In Real Estate business there is a huge difference in marketing rates,when we compare tier 2&3 cities with metros. So there is a very limited scope of negotiations in tier 2&3 cities.As far as material procurement is concerned they are already ATMANIRBHAR.,Agarwala said.
 CA Kirit Kalyani , Chairman of Nagpur Branch of ICAI shared his insights on the vital role of the professionals to guide their clients in proper financial planning & wise decision making.He said that role of each citizen is important to collectively overcome the financial challenges in view of COVID-19.He further said that MSMEs are the pillars of the economy & on case to case basis proper assessment should be done by the lending institutions with due diligence & taking help of the professionals.Compliances need to be fulfilled & data bank needs to be properly prepared & utilized.

The scope of work and recognition for Company Secretaries in the country, has gone beyond just being a Compliance Officer. They are now called the Governance Professionals and rightly so as they now are seen as a key role player in the Overall Governance Structure of not only the corporates but of the entire country.

The Institute of Company Secretaries of India (ICSI) has been working on developing Model Governance Codes for various entities in the country. Aligning to this momentum the ICSI recently organised a webinar on the theme “Governance – from Grass root to Global”. Hon’ble Speaker of the Loksabha Sri Om Birla was the Chief guest at the webinar.

Appreciating the initiatives undertaken by ICSI during the lockdown, Shri Birla acknowledged the role played by the Company Secretaries in making “Atmanirbhar Bharat” a reality. Shri Birla emphasized on strengthening local governments at the rural and urban levels.

“Company Secretaries are playing a commendable role in strengthening the Business Environment and Corporate Administration of the country and they should further pledge to turn challenges into opportunities and strengthen the rural economy of the country as well “, he said.

The webinar was attended by over sixty thousand ICSI members and professionals.

CS Ashish Garg, President ICSI, briefed the audience about the various initiatives specifically curated by the Institute during the lockdown for the professional development of its members and students. He explained the importance and prevalence of good governance in the country, since ancient times, by sighting examples from our rich cultural past.

CS Dr.Shyam Agarwal, Member Appellate Authority and Past President ICSI, gave an insight of the Four Governance Codes introduced by ICSI in 2017. The Model Governance Code for Gram Panchayat, Corporate Anti-Bribery Code, Code for Charity Governance and the Corporate Governance Code based on Ancient Scriptures had all won accolades from Hon’ble Prime Minister Shri Narendra Modi in 2017.

Prof. Ramesh K Arora, Chairman Management Development Academy, Jaipur, offered several suggestions on reforming the governance system at various levels, particularly relating to monitoring of work and a system of rewards and punishment.

Recently Nagpur Branch of WIRC of ICAI, hosted Webinar on – “Office Automation – Ensure Office Working at All Times”. The current global pandemic in the form of COVID-19, has created a paradigm shift on the way a professional should approach work. The ongoing crisis is although a bane but it is important to set expectations right and have a positive outlook at the opportunities and challenges so as to mould in into a boon and ensure office working at all times. Keeping these aspects in mind Nagpur Branch of ICAI had organized an apt program in the form a webinar for CA Members, which was very well attended by more than 150 members.

 

  1. Nihar Jambusaria Hon. Vice President ICAI, Mumbai, lent gracious presence to the webinar and guided the members attending, with his inaugural remarks, on the occasion. He congratulated Team Nagpur led by CA Kirit Kalyani, Chairman, for planning apt webinars including the one on hand, for the benefit of members in the profession. He graced the webinar and lent his words of wisdom on the occasion. He guided the members right from making first and positive impression to initiating discussion, dos and donts in the meeting, dealing with technical questions, etc. He also dealt with the required steps to be taken, post meeting with prospective client, including writing a thanks giving mail, required details required to be shared, etc. CA Murtuza, who played a major role in the matter of coordinating efforts for the webinar, as well, before concluding, dealt with the querries of the members and resolved the same very effectively.

  1. Adarsh Madrecha, Mumbai,the third speaker on the occasion, guided the members with respect to effective modes of Working Remotely. Crucial aspects including Data Access to Team Members, Collaboration, beautiful initiative of the ICAI about the maturity model, were effectively discussed. Public Collaboration Storage options, benefits and pitfalls, were effectively discussed by the speaker.Tools that can be used for communicating with team members, were discussed. He also guided the attendees as regards Digital Competency Maturity Model Version 2 document, which is aimed at helping the professionals to ensure effective professional life. The said model brought out by Digital Accounting &  Assurance Board of ICAI, effectively enables to make a self assessment of firms to know the level at which we stand. This then, enables us to plan further, to reach the expected milestone in our professional arena, he said.
  2. Ankit Raipuria,Mumbai,the last but not the least speaker, guided with the fourth pillar in the lives of professionals. Team Management, was the topic of discussion for him. He effectively conveyed the importance of mutual trust and respect, prompt communication, transparency, acknowledgement of work responsibility, conflict resolution, leader – subordinate relation, etc. He also shared his profile in professional arena and guided the members with the crucial aspects of task management including from receiving data, verification, effective compilation, etc. He shared idea about practice management softwares to effectively excel in our lives. He went on to add words of wisdom to his deliberation and also conveyed tips to make team work effectively from home or from any place. Equity benchmarks defied gravity for the fourth straight session on Monday as robust buying in banking, financials and IT counters offset lacklustre global cues amid mounting COVID-19 cases. Starting the session on a positive note, the BSE Sensex marked the day’s high at 37,478.87, before closing at 37,418.99, up 398.85 points or 1.08 per cent. Likewise, the broader NSE Nifty climbed 120.50 points or 1.11 per cent to end at 11,022.20.

The Sensex has now gained 1,385.93 points in four sessions, while the Nifty has advanced 414.85 points. Bajaj Finance was the top gainer in the Sensex pack on Monday, spurting 4.23 per cent, followed by Bajaj Finserv, HCL Tech, Tech Mahindra, Infosys, HDFC Bank and ICICI Bank. Market heavyweight HDFC Bank accounted for most of the gains on the benchmark after posting strong results over the weekend.

The country’s largest private sector lender clocked a nearly 20 per cent rise in standalone net profit at Rs 6,658.62 crore for the June quarter on the back of healthy interest income driven by growth in advances. Sun Pharma, NTPC, Maruti Suzuki, Kotak Mahindra Bank and L&T were among the losers, shedding up to 3.86 per cent. —

The trade associations will raise the bugle for a movement against the across the country and will make loud slogan china Quit India” in about 600 cities of Mr. BC Bhartia, National President and Mr. Praveen Khandelwal, Secretary General of the CAIT said that in view of the way China has occupied the retail market of India through Chinese products in the last 20 years under a long strategic planing and also the changed circumstances, it is very important to liberate the country’s retail market from Chinese products and create a self-reliant Indian market and to reduce Country’s dependence on China.

They said that the people of the country supported the CAIT campaign of celebrating the recent Rakshabandhan festival as Hindustani Rakhi and completely boycotted the Chinese Rakhi as a result of China has suffered a loss of Rs. 4 thousand crores rupees. It is clear from the fact that if the people of the country take a resolution and boycott Chinese goods, then India’s business can get independence from China very soon and 7 crore traders of the country under the leadership of CAT have taken this resolution firmly. .

Mr. Bhartia and Mr. Khandelwal announced today that all the upcoming festivals celebrated in the country will be celebrated using Indian goods and Chinese goods will not be used at all. They said that the upcoming festivals include Janmashtami, Ganesh Chaturthi, Navratri, Dussehra, Dhanteras, Diwali, Bhaiya Dooj, Chhath Puja and Tulsi Vivah will be celebrated in full form in traditional Indian way and especially this year Diwali will be celebrated across the country as Hindustani Diwali. CAIT has already started extensive preparations for the upcoming festivals.

Mr. Bhartia and Mr. Khandelwal told that under the China Quit India campaign, the government will be demanded to immediately ban Chinese company Huawei in rolling out the 5G network and also order exit of Chinese companies that have invested in the startup units of the country and provide necessary financial assistance to such startups. According to the government steps , 59 Chinese apps have been banned in India and in the same line the government should immediately ban the remaining Chinese apps. Praising the Central Government for taking all steps from time to time in recent past, the Govt has rejected the participation of Chinese companies in various projects of the government, on the same lines, border areas, security related areas. where Chinese machines having IOT devices is being used should be banned since this device can inform the companies based in China, what work is being done by those machines, how much work is going on and other strategic and Important information can be sent which can be misused. Recently Nagpur Branch of WIRC of ICAI, successfully hosted Virtual CPE Meet cum Webinar on – “RERA – CA Certification & Audit under MAHARERA”. The current global health crisis in the form of COVID 19, has compelled to avoid fellowship meets including seminars and conferences for CA Members. However, Nagpur Branch of ICAI, continuing with its commitment to serve the cause of profession, continuously is organising webinars of due relevance for members. Hopefully, when this phase of prescribed compulsions gets over, Chartered Accountants will be facing challenges to revive the work flow on all fronts, including representations before concerned authorities, to convince with respect to the appropriateness of workings in the matter of certifications, etc. and audit reports concerning builders and developers fraternity. With this in mind and to enable members update their knowledge bases, Nagpur Branch organized webinar.

Shri. Girish Joshi, Dy. Secretary MAHARERA, graced the webinar with his gracious presence and congratulated the efforts of Nagpur Branch in the matter of serving the fraternity under the able leadership of CA. Kirit Kalyani. Law needs to be duly enforced and hence proper reporting for smooth implementation of MAHARERA provisions, is need of hour. This needs to be ensured to achieve desired transparency in the deals concerned. He presented his deliberation by classifying the same in three parts to make it simple and convincing for the attendees. He guided the members with all the critical aspects namely Overview, Certificates and Precautions and methodology to carry the audit. His indepth knowledge in the field was evident. He shared that Maharashtra became pioneer state in the year 2012, for implementing the Act. He went further to guide about the provisions of the MAHARERA Act which was implemented from May 2017, he added. The main purpose of the Act included provisions to plug loopholes either under earlier act MOFA [Maharashtra Ownership of Flat Act] which was for under construction property and was lacking due enforcement provisions, he conveyed. If something wrong doing was evidenced, customers needed to go to court for either civil or criminal matters, etc. Hence RERA came into picture to ensure transparency and efficiency of operations on part of builders and to promise fair transaction for consumers.

CA Ramesh Prabhu, fondly called as Housing Guru, went on and on to enlighten the members attending the webinar. He said that because of the provisions with respect to registering the project and agents, stakeholders and builders get secured. He clarified that both the cases of freehold and leasehold rights are also covered. He said that the parties entrusted to ensure effective implementation of provisions include architechts, engineers and Chartered Accountats. Further, it goes without saying that as the stakes are high, professionals need to be very careful while certifying, he remarked. He included various practical cases to make his presentation effective. He shared that, even housing society is also required to register. Further, penalties for non compliance are very heavy and the same can go upto thirty percent of cost of project, he added. He guided as regards disclosure requirements of inf by promoters. Registration procedure was also effectively discussed. He threw light on the provisions concerning consequences of revocation of registration of real estate project by the authorities on complaint from stake holders or suo moto, as well. Formats of certificates to be given by various professionals including architects, engineers and CAs, he shared. Chartered Accountants are entrusted with the crucial task of certifying from books of account as regards cost incurred on land and construction. This certificat effectively gives drawing power, he conveyed. Issues and intricacies to find the land cost and construction cost he shared. Value of land as per annual statement of rates is the basis to certify, important point he put forth. He resolved the querries of members after his effective deliberation.

On one side, nmc or government are lack of hospital beds, doctors, ventilators, medicines etc and other side they want to test all the people who have zero symptoms of covid-19 disease. The current global health crisis in the form of COVID-19, has put the things temporarily on pause mode. But, the phase has favourablycompelled us to think that, rendering of services to a client at a distance of 10Kms. or 20000 Kms., through online mode, is one and the same. To carry the said thought process further and to effectively make use of surplus time at disposal, Nagpur Branch organized International Webinar, for helping members to mark their presence in professional arena at abroad including USA, as well.

CA. Amarjit Chopra, New Delhi, Hon. Past President ICAI,lent gracious presence to the webinar and guided the members attending, with his inaugural remarks on the occasion. He congratulated Team Nagpur led by CA KiritKalyani, Chairman, for planning apt webinars at right juncture of time. His commitment to serve the fraternity was evident. He shared his experience with respect to Europe as well. If UK is excluded, and thought of Spain, Germany, etc., language can become a barrier to certain extent. But USA can prove to be a good source of opportunities, because of English speaking population there. He guided as regards CPA Qualification which is prerequisite to start practicing at USA. Also, it is required to have attestation and auditing services, he added. Registration with IRS is required to go for consultancy in the matter of taxation, he added. For instance, if planning to serve in the field of book-writing services, he said that everything is driven by tax return preparation services eventually. Hence, it needs to be in coordination with the consultant for the same, so as to ensure one stop shop for the required services, he remarked.

CA. Aradhana Aggarwal, Former Chairperson, US Chapter of ICAI, shouldered responsibility to guide as another resource person, very effectively. As regards first one, generally assurance services are the required major services and for that CPA Qualification is must. He along with persons acting in concert Suraj Omprakash Agrawal, Amit Ravi Agrawal and L7 Hitech Private Limited have acquired the equity shares. Ravi now represents 9.05% of the total issued and paid-up equity share capital of Infibeam Avenues — The leading digital payments and e-commerce technology platforms company.

TRADERS WELCOME COIVD-19 TESTING PROTOCOL NOTIFIED BY STATE GOVERNMENT : NVCC


Nagpur: Nag Vidarbha Chamber of Commerce (NVCC) representing 13 lac traders from the Vidarbha Region welcomes Government of Maharashtra’s order dated 21/08/2020 directing authorities below to refrain from directing traders and their staff for undertaking Covid test if there are no symptoms in them.

Ashwin Mehadia, President-NVCC appreciating the timely response of the State government by issuing the covid testing protocol, making it clear that testing is to be done only when there is any symptom or the person falls under high-risk category said that, we are expecting similar response from government in the matter of Trade License order issued by Nagpur Municipal Corporation which is ultra-vires to Article 14, 19 and 21 of the Constitution of India.

Adv. Sanjay K. Agrawal, Vice President-NVCC said that, the recent order issued by Nagpur Municipal Commissioner, mandating every shop/office to obtain trade licence from Corporation is not only lacks jurisdiction but also is in violation to procedure prescribed for under the Maharashtra Municipal Corporation Act 1949. Commissioner without following the provisions to make, add, alter or rescind the rules, regulations and bye-laws by Corporation has directly issued the Trade License Order.

Agrawal further said that, the Section 376 of the MMC Act, under which the order is claimed to be issued, in unequivocal terms states that only specified things, trades and operations as specified in rules can be asked to obtain a license. The list of goods, trades and operations which can be regulated by Commissioner are mentioned in Chapter XVIII of Schedule-D of the MMC Act. The Act doesn’t empower the Commissioner to control the goods, trades and operations not mentioned in the said chapter. The Commissioner in his order has prohibited every trade and profession (including offices of Advocates, Engineers, Charted Accountants, Company Secretary, Banks, Insurance, Cooperative Society, etc.) within the territorial jurisdiction of Nagpur Municipal Corporation to operate without obtaining a trade license. Thus, the said order is ultra-vires to the provisions of the MMC Act, he added.

Ramawtar Totla, Secretary-NVCC, in reference to Commissioners first statement in press that, the trade license will enable the civic body to know the details of business and services operating in its jurisdiction and accordingly make necessary provisions in the new development plan (DP) in making, and second that said data is required by Centre for Smart City Project said that, introduction of new license raj is not required to gather such information, same can be procured from the Shop & Establishment Department at the click of a button. Shop & Establishment Department of our State is now fully computerised and operational, at least in Nagpur. Totla further said that, the order promotes duplication of work, NOC from fire department and zoning certificate is obtained by builder before construction and sanction of building plan, the order stipulating to again obtain the same as condition precedent for issuance of license is sheer wastage of precious man-hours of administration and public as well.

President, Ashwin Mehadia and Secretary Ramawtar Totla appealed traders, not to apply for trade license till further notice and they should inform Chamber if any coercive action is taken by NMC officers or they pressurise for applying or obtaining trade license.

Nagpur: Dipen Agrawal, President of Chamber of Associations of Maharashtra Industry & Trade (CAMIT) welcoming the order dated 21.08.2020 issued by Government of Maharashtra clarifying that traders and their staff is not required to get Covid-19 tested if they do not have any symptoms, said that this is clear indication to all nodal officers to judiciously use the discretionary powers conferred on them under the Epidemic Act and Disaster Management Act.

CAMIT had strongly objected to the irrational diktats issued by nodal officers across the state making it mandatory for traders and their staff to undertake Covid-19 test and in some cities, it was directed to get tested at private labs. Maharashtra Governments covid-19 testing protocol order has saved many citizens from contacting the virus by mingling with doubtful cases in government/private testing centres, he added.

Dipen Agrawal, expressed gratitude to Chief Minister, Uddhav Thackeray, Guardian Minister (Nagpur), Dr. Nitin Raut for sensitively considering the hardship being faced by the traders due to corona-virus pandemic and saving them from the mental agony and financial burden of uncalled for Covid testing. He also expressed gratitude towards the Mayor, Sandeep Joshi and all elected members of political fraternity for supporting and taking-up the trader’s rightful demand to recall the mandatory Covid testing order.

Dipen Agrawal, appealing to Chief Minister, Uddhav Thackeray, Guardian Minister (Nagpur), Dr. Nitin Raut said that, business community and professionals from Nagpur expect similar justice from State Government in the matter of untenable Trade License order issued by Nagpur Municipal Commissioner recently.

COSIA Urges Government to Extend Moratorium and Relief Period for MSMEs

Chairman of Chamber of Small Industry Associations Vidarbha Shri Mayank Shukla, informed that less than 40% industries under MSME sector are working to the extent of more than 50% of its capacity. Under these circumstances, the Industries particularly under micro and small category are facing numerous problems like funds liquidity crunch,migration of labour problems, procurement of further orders and execution of existing ones,supply chain,transportation and fulfillment of statutory compliances etc

Delayed payments from suppliers particularly from PSUs, Corporates and large scale Industries adds fuel to their woes.CA Julfesh Shah,Vice Chairman,COSIA said that although RBI has announced extension of moratorium upto 31st Aug 2020,still MSME sector is reeling under tremendous pressure & facing a stiff challenge to reasonably survive in this peak COVID period & in view of this the moratorium period on the financial facilities availed by them need to be further extended till 31st Dec 2020.Mr Shah further added that in the present situation if moratorium period is not extended it may lead to rise in the number of overdue accounts & eventually may increase NPA percentage considerably in the MSME sector.

Although number of relief packages are announced by the Govt.for MSMEs, but the situation has not improved to the extent desired.Under such situation it is urged by COSIA to the Finance Ministry & MSME Ministry that clearance of outstanding payments to micro and small level Industries needs to be done on topmost priority, otherwise several micro and small scale Industries are likely to be permanently closed thereby creating a huge job cuts and reduction in direct and indirect employment.

Shri Shukla has further urged the Goverment to expedite the release of relief offered to MSME sector.Simply relaxing norms do not help the actual beneficiaries but it only broadens the area of its scope.

It is also most earnestly urged that the Provident Fund relief granted by the Government needs to be further extended upto December’20. This relief of contribution of PF on behalf of Employers and Employees (Total 24%) has enabled employers with more liquidity and employees to carry heavier pay packets.This also improves the purchasing power of employees thereby creating demand in market and strengthening Nation’s Economy to certain extent.

COSIA has also humbly appealed to Government to remove the rider of eligibility criteria that is having an employment more than 90% drawing below 15,000/- per month.This will enable more number of beneficiaries to take its advantage.

CA Julfesh Shah said that in the present scenario when the Unlock 3.0 is half heartedly implemented that too by few states because of COVID-19 fear still persisting, it is utmost important to continue with moratorium and relief package for MSME sector till December’20 which will provide some solace to the under pressure trade & industry at large.
